Every year, many people lose their lives in railway accidents. Sometimes it happens due to their fault. The Railway Claims Tribunal Act, 1987, was enacted to provide speedy disposal of claims against railway administration.

Even though the railway administration created a way to compensate the consignor/consignee and also for the loss of life and property, still people were often not satisfied and would approach the courts, which took a lot of time in deciding the claims. It took a long time and the litigation became protracted. Indefinite Period Therefore, a need was felt to expedite the disposal of claims as soon as possible, resulting in the setting up of claims tribunals, which would specifically deal with such claims and dispose of them expeditiously. As a result, the burden on the courts is reduced and quick relief is available. Even refunds of fares and freight were brought under the preview of the tribunal. The RCT Act provides for the establishment of a Railway Claims Tribunal to investigate and determine claims against the Railway Administration for loss, destruction, damage, deterioration, or non-delivery of animals or goods entrusted to be carried by the Railways.

Refund of passenger fare or compensation for death or injury to passengers caused by carriage of freight or as a result of railway accidents or untoward incidents and for matters connected therewith or incidental there to.

The scheme of the Act shows that it made provisions for the establishment of the tribunal, its benches, officers and employees, their tenure, eligibility, jurisdiction, powers and authority of the tribunal, its procedure, its orders and the execution of appeals. Thus this Act is a self-contained Act, which has solved the problems of the public at large.

With the aim of providing justice to the victims of rail accidents in India, Life Saving Organization has formed a group of volunteers at the district and tehsil level across India who have themselves been victims of some incident or have experienced that pain.

In India, the justice system has been considered supreme since ancient times, the judge has always received the status of God. But just as in ancient times, some greedy employees working in the first echelon of the justice system were dishonest and bribe takers, in the same way in the present time, some investigating officers, employees/police employees, or researchers who are investigating the case act for their own personal interest and ill-will and arrogant nature to achieve this, they defame the principle of justice. In the said tainted research, the dignity of justice is propounded by the judiciary only with the help of judges by intelligent, experienced and senior lawyers.

Life Saving Organization has formed a panel of the best lawyers in most of the Railway Claim Tribunals across India with the aim of providing justice to the railway accident victims in India. Under the guidance of the above senior experienced lawyers, efforts are made to provide speedy justice to the railway accident victims in the Railway Claim Tribunal.
